2. Your data
Ownership

License to process
You grant Nissa a limited, non-exclusive license to process Your Data solely for the purpose of providing and improving the Service for you. We will not use Your Data to train general-purpose machine learning models or share it with third parties except as described in our Privacy Policy.
Data handling
We treat Your Data as confidential. Upon termination of your account, we will delete Your Data within 30 days unless retention is required by law. You may request data export at any time during an active subscription.
3. Service availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.
4. Fees and payment
Certain features of the Service require a paid subscription. Fees are as described on our pricing page or in a separate order form. Unless otherwise specified:
- Fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We may change fees upon 30 days' notice before your next billing period
5. Intellectual property
The Service, including its design, features, code, documentation, and branding, is owned by Nissa and protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or other brand features without prior written consent.
6. Limitation of liability
To the maximum extent permitted by law, Nissa's total liability for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.
7. Indemnification
You agree to indemnify and hold Nissa harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
8. Termination
Either party may terminate these Terms at any time. You may cancel your account through the Service or by contacting us. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately, and we will handle Your Data as described in Section 2.
9. Modifications
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Your continued use of the Service after changes constitutes acceptance. If you do not agree to the updated Terms, you may terminate your account.
10. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any disputes shall be resolved in the federal or state courts located in Delaware.
